1. Summary
In short, we encourage you to download video for personal and educational usage, but you are not allowed to distribute the video, put it to any commercial use, or alter the content in any way.
2. The Agreement and the Service
Nobel Web AB is responsible for Nobelprize.org, the official website of the Nobel Foundation.
Before using the Nobelprize.org Downloading Service, carefully read these Downloading Terms of Use, the Nobelprize.org Privacy Policy at http://nobelprize.org/nobelweb/privacy_policy.html, and the Nobelprize.org Terms of Use at http://nobelprize.org/nobelweb/terms_use.html (collectively, the "Agreement"). If you use the Nobelprize.org Downloading Service, you fully and irrevocably accept and agree to be bound by the Agreement. If you do not wish to accept all the terms of the Agreement, you may not use the Service.
The Nobelprize.org Video Download Service (the "Service") offers mp4 versions of video content from Nobelprize.org (collectively, the "Video Content") under certain terms and conditions as set forth in this Agreement. The Service allows you to access and view the Video Content by downloading a copy.
3. License to Download Video Content
Ownership. Nobel Web AB is the owner and proprietor of the Video Content, which is protected by the copyright laws of Sweden, as well as other intellectual property laws and treaties. Except for the rights explicitly granted to you in this Agreement, all right, title and interest in the Service and Video Content are reserved and retained by Nobel Web AB. You do not acquire any right, title or interest in the Video Content as a result of downloading it.
Non-Commercial, Personal or Educational Use Limitation. Nobel Web AB grants you a non-exclusive, non-transferable, non-sub licensable, limited right and license to download, to retain permanent downloaded copies of and to view, use and privately display, for Non-Commercial, Personal or Educational Use, the Video Content in strict conformity with the Agreement.
As used herein, "Non-Commercial, Personal or Educational Use" means a presentation of the Video Content for which no fee or consideration of any kind is charged or received, which takes place (i) in your private home or apartment or, if outside your private home or apartment is limited to a private viewing for you and your invitees, or (ii) for educational purposes, in class-, seminar-, meeting, conference- or lecture rooms, irrespective of a consideration be charged for participating in the educational context as such. For the avoidance of doubt, presentation of the Video Content for any marketing purposes, notwithstanding the character of the marketed activity, or commercialisation in any other way of the Video Content, is never allowed.
All other rights are reserved by Nobel Web AB, and any other use or exploitation of the Video Content is strictly prohibited. You may, by way of example and not limitation, subject to the other terms of the Agreement, NOT:
i. sublicense, lease, sell, transmit, distribute, broadcast, export or assign any right to the Video Content to any third party;
ii. alter, adapt, customize, edit, modify, translate, add to, delete from, or create derivative works based upon any portion of the Video Content;
iii. remove any proprietary or rights notices or labels on the Video Content;
iv. use the Service or Video Content for any commercial or illegal purpose;
v. attempt to circumvent, avoid, bypass, remove, deactivate, impair or otherwise defeat any digital rights management system used as part of the Service;
Delivery of Content. You acknowledge that use of Video Content may require the use of other hardware and software products and that such hardware and software is your responsibility.
4. Disclaimer of Warranty
As with any on-line interaction and electronic communication, there is an inherent risk involved in transmitting any information via the Internet. Nobel Web AB does not and cannot guarantee that its system is free from hackers or viruses or that information provided by users to Nobel Web AB will not be stolen or otherwise surreptitiously obtained. Nobel Web AB is not responsible or liable for any infections or contamination of your system or delays, inaccuracies, errors, or omissions arising out of your use of the Service.
Nobel Web AB does not warrant that the Service will be uninterrupted or error free, free from viruses or security breaches; nor does Nobel Web AB make any warranty as to the results to be obtained from use of the Service. The Service or the Video Content is not guaranteed to be accurate, timely or verified. Nobel Web AB does not make any warranties of any kind, either express or implied, including, without limitation, warranties of title or warranties of merchantability or fitness for a particular purpose, with respect to the Service or the Video Content.
5. Indemnity
You hereby agree to indemnify, defend and hold harmless Nobel Web AB and its affiliates from and against any and all liability and costs incurred by Nobel Web AB or the affiliates in connection with any claim arising out of any breach or alleged breach of any of your obligations set forth herein.
6. Limitation of Liability
Under no circumstances, including but not limited to negligence by Nobel Web AB, shall Nobel Web AB be liable for any direct, indirect, incidental, special, incidental or consequential damages of any kind under any legal theory arising out of the use of or the inability to use the Service or the Video Content, even if Nobel Web AB has been advised of the possibility of such damages.
7. General Terms
Termination. The Agreement is effective until terminated in accordance with the terms hereof. If you fail to comply with any of the terms or conditions of this Agreement, your license to the Video Content terminates immediately, and this Agreement will terminate immediately without notice from Nobel Web AB. Either party may furthermore terminate the Agreement at any time. In such event, you must erase, destroy or otherwise remove all copies of Video Content that you have downloaded from all computers and portable devices within your possession or control.
No Right to Continued Service. Nobel Web AB reserves the right to add, modify, delete, suspend, limit access to or discontinue the Service, or any part thereof, at any time at its sole election and without notice to you, and Nobel Web AB will not be liable to you should it exercise such rights, even if your use of the Video Content is impacted by the change.
Changes. Nobel Web AB reserves the right to make changes to this Agreement at any time. Any change is effective immediately upon posting at Nobelprize.org. Your continued use of the Service following any such changes will constitute your acceptance of the changes.
Severability. If any provision of the Agreement is held invalid, unenforceable or void, the remainder of the Agreement shall not be affected thereby and shall continue in full force and effect.
Governing Law. The Agreement is governed by the laws of Sweden.
